Terms and Conditions
Welcome to the HUMANS Deep Space Message project website (the “Site”), operated by Powerhouse Museum, part of the Museum of Applied Arts and Sciences, a body corporate established under the Museum of Applied Arts and Sciences Act 1945 (NSW) (Powerhouse). By accessing or using this Site, you agree to be bound by the following terms and conditions. If you do not accept these terms, please do not use this Site.
These terms may be updated by Powerhouse. We encourage you to check this page each time you use the Site, as your continued use of the Site indicates your acceptance of any revised terms.
1. Voluntary Participation
Use of this Site and participation in the HUMANS Project is entirely voluntary. Further information about the Project is available on the Site. If you do not agree to be bound by these terms, you should exit the Site and refrain from submitting any content.
2. Grant of Rights
By submitting any content, including audio or text, (“Submission”), you grant to each of Powerhouse and its sublicensees including Massachusetts Institute of Technology (MIT) a non-exclusive, irrevocable, royalty-free, perpetual, worldwide sub-licensable licence to:
- Use, reproduce, modify, adapt, communicate, publish, publicly display and distribute your Submission in any medium or format
- Create derivative works from your Submission
- Use your Submission for non-commercial, educational, historical, archival, curatorial and research purposes, including exhibition or public engagement
This licence allows Powerhouse and its sublicensees including MIT to incorporate your Submission into the Project and associated public programming and research.
3. Attribution
Submissions may be attributed to you by name unless you request anonymity. Attribution is at the discretion of Powerhouse, or MIT as the case may be, and you also consent to Powerhouse, MIT and respective sub-licensees not attributing your Submission to you by name.
4. Selection and Removal
Powerhouse and MIT reserve the right, but not the obligation, to review and determine which Submissions are included in the Project. Powerhouse, MIT and their respective sub-licensees may, at their discretion, edit, publish or remove any Submission at any time without notice or explanation.
5. Your Responsibility and Rights
You remain the owner of the intellectual property in your Submission, subject to the licence granted in Clause 2. You represent and warrant that:
- You are the creator and copyright holder of the Submission, or
- You have obtained all necessary rights, permissions and consents (including from third parties featured in audio or text) to allow Powerhouse to use the Submission as outlined, and
- Your Submission, and the permitted uses of it under these terms, does not and will not infringe any copyright, moral rights, trademark, privacy, publicity or other legal rights of any third party.
6. Compliance with Laws
You must ensure your Submission complies with all applicable laws of Australia, including but not limited to those relating to:
- Defamation and vilification
- Privacy
- Copyright and intellectual property
- Racial discrimination and hate speech
- Criminal law
You must also ensure your Submission does not contain content that:
- Harasses, threatens or vilifies any person or group
- Incites violence or illegal activity
- Is misleading, false or fraudulent
- Is obscene, pornographic or otherwise offensive
- Constitutes commercial advertising or political campaigning
- Includes personal data of others without consent
7. US Publication
To the extent applicable, you acknowledge that neither Powerhouse nor MIT is the publisher or speaker as to any Submission submitted by you for the purposes of any law, including in the US 47 USC § 230(c)(1).
8. Privacy
Powerhouse and MIT are committed to protecting your privacy under applicable laws including the Privacy and Personal Information Protection Act 1998 (NSW) where applicable. The handling of personal information collected in connection with the Project is described in the Privacy Statement available on the Site and includes sharing of that information with MIT in the US and public display of your submission for the Project. If you provide personal information about any third party, you must ensure they have been provided the Privacy Statement and agree to you providing their personal information to Powerhouse and MIT.
9. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Powerhouse and MIT (Indemnified Parties) against any third-party claims, including any losses, liabilities, damages or expenses (including legal fees) in connection with any third party claims (“Claims”) that the Indemnified Parties suffer or incur arising from your breach of these terms (including any breach of warranty), except to the extent that any such Claims arise from the breach, negligence or other wrongful act or omission of the respective Indemnified party.
10. Governing Laws and Jurisdictions
These terms are governed by the laws of the State of New South Wales and the Commonwealth of Australia. Any disputes arising in connection with the Site or the Project will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
